Five HS classification mistakes that cost importers money

A wrong HS code is not just a fine: it means a value adjustment, days in the temporary storage warehouse and a preferential rate you can no longer claim.

The HS code determines three things: the duty rate, whether permits are required, and eligibility for free-trade preferences. A single wrong digit changes all three. Here are the five scenarios we see most often.

1. Classifying by purpose instead of composition

The classic case is textiles. The importer picks a «workwear» code because the goods are sold as work uniforms, whereas the deciding criteria are fabric composition and method of manufacture. The rule is simple: material and technology first, purpose second.

2. Splitting a set into parts

Equipment shipped knocked-down is often declared as separate assemblies. Sometimes that is advantageous; sometimes it is a straight breach: if the set forms a functionally complete article, it must be classified as one. That call is made before dispatch, not at the border.

3. Ignoring the section notes

Section and chapter notes take priority over «common sense». A product may look like electronics while a note explicitly excludes it from chapter 85. Checking the notes takes ten minutes and removes most disputes with the inspector.

4. Preference not backed by a document

Entitlement to a reduced FTA rate arises not from the fact of origin but from a correctly issued certificate of origin. Form, validity and consistency with the routing are critical: a certificate issued after dispatch without the «issued retrospectively» mark will be rejected.

5. The code is chosen after dispatch

The most expensive mistake. Once the container sits in temporary storage, every waiting day costs money and the decision is made in a hurry. The correct order is the reverse: the code is fixed before the contract is signed, because it drives the landed cost and therefore the viability of the deal itself.
